Terms of Service

These Terms of Service ("Terms") govern your access to and use of the PUMSdata website, applications, and services (collectively, the "Service"), operated by [Company Legal Name] ("we", "us", or "our"). By accessing or using the Service, or by creating an account, you agree to be bound by these Terms. If you do not agree, do not use the Service. Your purchase and use of a paid subscription is also governed by our Service Agreement, which is incorporated into these Terms by reference.
1. The Service
The Service provides an interactive interface, tools, maps, and visualizations built on public data published by the U.S. Census Bureau, including the American Community Survey (ACS) Public Use Microdata Sample (PUMS). We are an independent product and are not affiliated with, endorsed by, or sponsored by the U.S. Census Bureau or any government agency.
2. Eligibility & Accounts
- You must be at least 18 years old and able to form a binding contract.
- You are responsible for the accuracy of your registration information, for keeping your credentials confidential, and for all activity under your account.
- Notify us promptly of any unauthorized use of your account.
3. Acceptable Use
You agree that you will not, and will not permit others to:
- Attempt to re-identify any individual, household, or respondent in the underlying microdata, or combine it with other data for that purpose. The Census data is de-identified, and re-identification attempts are strictly prohibited.
- Use the Service for any unlawful purpose, or to discriminate against any person or class of persons in violation of applicable law (including fair-housing, lending, or employment laws).
- Scrape, harvest, or use automated means to extract data beyond the export features we provide; or circumvent rate limits, access controls, or usage limits.
- Resell, sublicense, redistribute, or commercially exploit the Service or its compiled datasets, or use them to build or train a competing product or service.
- Reverse engineer, decompile, or attempt to derive source code, except to the extent permitted by law.
- Interfere with or disrupt the integrity or performance of the Service, or attempt to gain unauthorized access to it or its related systems.
- Upload or transmit malware, or infringe the intellectual property or rights of others.
4. Data Source & Accuracy Disclaimer
Statistics presented by the Service are survey-based estimates derived from Census PUMS microdata using sample weights, and are subject to sampling and non-sampling error. They are provided for informational and analytical purposes only. We do not warrant that any estimate is accurate, complete, current, or fit for a particular purpose, and the Service should not be the sole basis for any financial, legal, employment, lending, housing, or other consequential decision. The underlying Census data are a work of the U.S. government and are in the public domain.
5. Intellectual Property
The underlying Census data are public domain. However, the Service's software, design, user interface, visualizations, optimized geographic files, derived datasets, and compilations (the "Materials") are owned by us or our licensors and are protected by intellectual-property laws. Subject to these Terms and your active subscription, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business or personal research purposes.
6. Your Content
"Your Content" means saved maps, segments, comparisons, settings, and similar items you create. You retain ownership of Your Content. You grant us a limited license to host, store, process, and display it solely to operate and provide the Service to you. You are responsible for Your Content and for exporting anything you wish to keep before your access ends (see the Service Agreement).
7. Subscriptions & Payment
Paid features require a subscription. Pricing, billing, renewal, cancellation, the no-refund policy, and the effect of cancellation on your data are described in the Service Agreement. Payments are processed by our third-party payment processor (Stripe); by subscribing you also agree to its terms.
8. Privacy
Our handling of personal information is described in our Privacy Policy. By using the Service you consent to the collection and use of information as described there.
9. Termination
You may stop using the Service at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms or the Service Agreement, or to comply with law or protect the Service or other users. Upon termination or cancellation, your right to use the Service ends and, as described in the Service Agreement, you will lose access to Your Content, which may be deleted.
10. Disclaimer of Warranties
THE SERVICE AND ALL MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
12. Indemnification
You agree to indemnify and hold harmless [Company Legal Name] and its officers, employees, and agents from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service or your breach of these Terms.
13. Changes
